Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307, 323, 506/34 and other sections of Indian Penal Code.

As per F.I.R., this petitioner along with one other accused person inflicted injury on the head of the informant and pierced iron rod into his cheek.

Learned counsel appearing for the petitioner submits that F.I.R. has been lodged after inordinate delay of 7 days without any explanation. As a matter of fact, both the parties are co-villagers and daughter of the informant had committed theft of jewellery from the house of the petitioner for which mother of the petitioner had filed a Complaint Case No. 604 of 2022

Patna High Court CR. MISC. No.44548 of 2022(4) dt.20-03-2023 2/2 and in retaliation this false case has been lodged against the petitioner. It is next submitted that petitioner is alleged to have caused 3 injuries out of which 2 are simple in nature and opinion of the third injury has been kept reserved by the doctor. Petitioner claims clean antecedent.

Considering the delay in lodging the F.I.R. and clean antecedent of the petitioner, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in Bhabua (Sonhan) P. S. Case No. 324 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
