2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 103(1) of the BNS and Section 27 of the Arms Act.
3. As per FIR, suspicion of conspiracy in committing murder of the son of the informant has been raised against the petitioner.
4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. No overt act has been raised against this petitioner. Prior to institution of the present case, Kotwa P.S. Case No. 259 of 2024 was lodged with respect to the same occurrence in which 8
Patna High Court CR. MISC. No.46408 of 2025(4) dt.17-11-2025 2/2 persons were named in the FIR with the allegation that accused Suresh Pandey shot the deceased dead and petitioner was not made accused in that case. Petitioner claims clean antecedent.
5. Learned counsel for the informant opposes the bail petition.
6. Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-X, Motihari, East Champaran in connection with Kotwa P.S. Case No. 260 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) AjayMishra/- U T
