Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-06-2021 Heard Mr. Yogesh Chandra Verma, the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Sadar P.S. Case No. 200 of 2017, dated 12.05.2017, instituted for the offences under Sections 302, 307, 323, 341, 342, 337, 338, 147, 148 and 149 of the Indian Penal Code.

Patna High Court CR. MISC. No.40661 of 2020(2) dt.17-06-2021 2/3 According to the F.I.R., Manish Kumar, Niraj Kumar and the informant were assaulted by approximately fifteen to sixteen persons. Aforesaid Manish and Niraj succumbed to the injuries, whereas the informant could, somehow or the other, survived.

It has been submitted on behalf of the petitioner that he has not been named in the F.I.R. and his accusation in this case is only on the basis of confession of one Mukesh Kumar who has named him along with other persons. It has further been submitted that some of the accused persons of this case with similar allegation have been granted the privilege of anticipatory bail by different Benches of this Court.

Some of the orders have been brought on record vide Annexure-2 to this bail application.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees

No.40661 of 2020(2) dt.17-06-2021 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. The application stands allowed.
