The petitioner seeks bail in connection with Jandaha P.S. Case No. 123 of 2022 registered for the offence under Sections 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code The accused/petitioner is named in the F.I.R. and is in custody since 26.04.2022.

The allegation against the petitioner is to assault informant, alongwith other co-accused persons, causing head injury and also to snatch golden chain and taken away cash of Rs. 59,000/- (Rupees Fifty-nine Thousand) from the house of

Learned counsel appearing on behalf of the petitioner submitted that the petitioner has been falsely implicated in present case due to neighbourhood disputes and differences. It is submitted that the whole family members have been implicated, where petitioner appears to be the father of co-accused Raj Kapoor, who alleged to assault on the head of the informant. It is further submitted that the allegation against petitioner is limited to snatch golden chain and same appears to only aggravate the allegation. While concluding the argument, it has been submitted that investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

Learned APP opposes the prayer of bail.

Considering the facts and circumstances as mentioned above and by taking note of accusation, where allegation is limited to snatch golden chain against this petitioner, where he is in custody since 26.04.2022 coupled with the fact that chargesheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Jandaha P.S. Case No. 123 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like
