JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Shahkund (Sajaur) PS Case No. 254 of 2017 registered under Sections 471, 379, 411, 188/34 of the IPC, Section 40 of B.M.C.C. Act and Sections 6/8 of Illegal Mining Transporting and Storage Act.. The allegation in brief is that petitioner no. 1, the tractor driver, was found carrying away sand in the tractor and the petitioner No. 2 is owner of the tractor.

Learned Counsel for the petitioners submits that petitioner no. 1 was transporting the sand which was of one Mahadev Enclave Pvt. Ltd and the petitioner no. 2 is tractor owner, they have no concern with the sand.

Having considered the said facts and circumstances, the petitioners, namely, Shukhdeo Singh @ Sukdeo Singh and Bibhas Singh @ Dibba are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by both of them with two sureties of the like amount each to the satisfaction of SDJM Bhagalpur in connection with Shahkund PS Case No. 254 of 2017.
