JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-02-2018 Heard the learned counsel for the petitioners, the learned counsel appearing for the State as well as Mr. Raju Giri, learned counsel appearing on behalf of the University. Mr. Binodanand Mishra, learned counsel for the petitioners submits that the cases of the petitioners are identical to

Patna High Court CWJC No.2671 of 2016 (9) dt.07-02-2018 3/3 the case of Dr. Jagdeo Prasad Yadav, the petitioner in C.W.J.C. No. 3418 of 2014, dated 28.08.2014, (Annexure 7) whereas Mr. Raju Giri submits that the order, contained in Annexure 8, needs to be re-looked in view of the fact that certain aspect of the matter has been considered in that writ application. Prima facie, I am of the view that the decision of the coordinate Bench is binding on this Court and if the respondents are to assail the decision, contained in Annexure 7, dated 28.08.2014, the Letters Patent Appeal or any other superior Court is the Forum and until contrary order by such Forum the respondents are required to follow the order of the writ Court. The order of writ Court is applicable to similarly circumstanced persons in view of the Bihar Litigation Policy. Accordingly, these writ applications are disposed of in identical terms of C.W.J.C. No. 3418 of 2014, which was disposed of by order, dated 28.08.2014.
