JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Barh P.S. Case No.391 of 2016 instituted for the offences under Section 30(a)/(C) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of various quantities of liquor from various persons and places. The learned counsel for the petitioner submits that neither recovery has been made from possession of the petitioner nor he was apprehended at the spot, the petitioner has a fair antecedent barring one other case, which has been instituted on same and similar allegation and he is in custody since 16.09.2017.

Patna High Court Cr.Misc. No.60966 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Barh P.S.
