2. Petitioner seeks regular bail in connection with Bhawan Bazar PS Case No. 247/2018 dated 14.06.2018 registered for the offence punishable under Sections 302/34 of the IPC.

3. This is the second attempt on behalf of the petitioner for grant of bail inasmuch as earlier on 07.03.2022 prayer for bail of the petitioner was rejected by this Court on vide Cr. Misc. No. 30651/2021.

4. This Court vide order dated 26.07.2023 called for a report from the learned 12th Additional Sessions Judge, Saran at Chapra, pursuant thereof, a report vide letter no. 173/ dated

Patna High Court CR. MISC. No.48058 of 2023(3) dt.25-08-2023 2/2 07.08.2023 has been received wherein the learned Additional Sessions Judge-VII, Saran at Chapra has stated that there are twelve witnesses named in the charge-sheet, no one has yet been examined as the charges against accused, Vikash Kumar Singh @ Tiger was framed on 28.06.2023 under Section 302/34 IPC and summons to witnesses have been issued on 10.07.2023. The next date fixed for evidence on part of prosecution is 11.08.2023, if the prosecution witnesses are produced on time the trial is likely to be concluded within six months.

Regards being had to the submissions made by the parties, taking into consideration that the petitioner is said to be the main assailant of the deceased and the report of the learned Additional Sessions Judge, Saran at Chapra, I am not inclined to grant bail to the petitioner at this stage. The same is, hereby, dismissed.

6. However, the petitioner will be at liberty to renew his prayer for bail after six months.
