JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Korha PS Case No. 223 of 2017 registered under Sections 302/34 of the IPC. The allegation in brief is that the deceased rebuked his son Saddam for marrying second time with the petitioner and on this account he was killed. The allegation against the petitioner is that she caught hold the deceased and thereafter Saddam, Gulab and this petitioner assaulted the deceased.

Learned Counsel for the petitioner submits that specific allegation is against Saddam who is said to have assaulted with garasa, a sharp cutting weapon, and cause of death is haemorrhage caused by sharp cutting weapon and there is general and omnibus allegation against the petitioner and not specific, she is not said to have assaulted with any sharp cutting weapon. The petitioner is second wife of Saddam and police has submitted charge sheet in this case.

Having considered the said facts and circumstances, the petitioner, namely, Anguri Khatoon is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Katihar in connection with Korha PS Case No. 223 of 2017.
