2. The petitioner seeks bail in a case, registered for the offence punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the FIR, informant got information on telephone that his nephew has been killed by somebody and his dead body was lying in a Red colour Magic car. On such information, informant went there and found the dead body of his nephew and he was informed by the people that they saw his nephew and his brother-in-law Rakho Singh and the petitioner one day before the occurrence.

4. Learned counsel for the petitioner submits that name of this petitioner transpired in this case on the basis of suspicion. Informant is not eye-witness to the occurrence.

Patna High Court CR. MISC. No.44153 of 2025(6) dt.25-11-2025 2/2 Chargesheet has already been submitted in this case. Petitioner claims clean antecedent and he is in custody since 27.03.2025.

5. Learned APP however, vehemently opposes the prayer for bail of the petitioner.

Considering the aforesaid facts, let the petitioner above-named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 349 of 2024.
