The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a), 37(b) and 37(c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, seeing the police personnel, the accused persons including the petitioner herein made an attempt to escape but were caught. A total of 130 litres of liquor was recovered from a can abandoned by them. On perusal of the record it transpires that the case of the petitioner is that he is innocent and has not committed any offence. No incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 3.3.2021 and has no criminal antecedent. Heard learned APP for the State.
