2. Pursuant to order dated 19.09.2018, respondent no. 5 is present and has also filed show cause.

3. The reason why the respondent no. 5 was required to be present in Court has been detailed in the order dated 19.09.2018. The stand taken in the show cause is unqualified and unconditional apology for having taken a stand on oath which was contrary to the law settled by the Full Bench of this Court in the case of Arvind Kumar Singh vs. State of Bihar reported as 2018(2) PLJR 933.

4. Further, in the show cause, details have been given with regard to payment of Gratuity in terms of the law laid down in

Patna High Court CWJC No.18873 of 2016 dt.11-10-2018 2/2 the aforesaid order of the Full Bench.

5. The same is not controverted by learned counsel for the petitioner.

6. Having regard to the aforesaid, as all admitted retiral dues of the petitioner have been paid, the writ petition having served its purpose, stands disposed off.

7. Personal appearance of the officer stands dispensed with.
