====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 21-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Muffasil (Lakho O.P.) P.S. Case No.458 of 2023 instituted under Section 392 of the Indian Penal Code.

3. As per the prosecution case, four unknown miscreants covering their faces with mask, looted the motorcycle, mobile phone and Rs.10,000/- from the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to the reason that SIM card of petitioner was inserted in the stolen mobile phone. He further submits that co-accused namely Abhijeet Kumar who is nephew of the petitioner was using his SIM card being the family member and the petitioner

Patna High Court CR. MISC. No.45976 of 2025(2) dt.21-07-2025 2/2 has no knowledge about the indulgence of co-accused in the occurrence. Learned counsel submits that there is no specific role attributed to the petitioner for taking part in the said crime. He further submits that petitioner has one criminal antecedent, in which, he is on bail and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned A.C.J.M. IV, Begusarai in connection with Muffasil (Lakho O.P.) P.S. Case No.458 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
