This application, for grant of anticipatory bail, arises out of Forbesganj (Simraha) Police Station Case No. 505 of 2018, disclosing offences under Sections 341, 323, 498A, 504 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, 1961.

The petitioners are father-in-law and mother-in-law of the informant.

Learned Counsel for the petitioners appears to be correct in his submission that allegation of demand of dowry is general and omnibus.

Considering the above, this application is allowed.

Patna High Court Cr.Misc. No.75888 of 2018(3) dt.09-01-2019 2/2 Let the petitioners, Bishundeo Mehta @ Bishun Mehta and Rekha Devi, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) Police Station Case No. 505 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
