JUSTICE BIRENDRA KUMAR ORAL ORDER 08-12-2021 Let the defects, if any, be removed within four weeks after complete start of the physical Court. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 498A/323/504B/506/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
Learned counsel for the petitioners submits that allegation is under Section 498A of the Indian Penal Code. Mediation between the husband and the complainant is going on before the Court-below. The petitioners are parents of the
Patna High Court CR. MISC. No.57163 of 2021(2) dt.08-12-2021 2/2 husband. There is chance of settlement of dispute. Considering the submission aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Darbhanga Mahila Police Station Case No.56 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. The petitioners shall not leave the country without permission of the trial Court.
