2. Earlier the bail application of the petitioner was rejected on 26.04.2024 in Cr. Misc. No. 85108 of 2023.

3. The petitioner seeks bail in connection with Amdabad P.S. Case No. 218 of 2023 registered for the offence under Section 341, 323, 307, 302, 504, 506, 120B/34 of the Indian Penal Code.

4. As per the prosecution case, the petitioner and other persons are said to have assaulted the deceased with stick.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there is general and omnibus allegation against all the accused persons and there is an

6. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 29.04.2024 and has clean antecedent.

7. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

8. Considering the aforesaid facts, this application is allowed.

9. Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I Class, Katihar/concerned Court below in connection with Amdabad P.S. Case No. 218 of 2023.
