JUSTICE SANJAY KUMAR ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Mahkar Police Station Case No. 67 of 2016 registered for offence punishable under section 395 of the Indian Penal Code. It has been submitted that this petitioner was neither caught at the spot nor any incriminating material has been recovered from his possession. His name transpired in confessional statement of three accuseds who were arrested by Police in course of investigation and except this discloser there is nothing against the petitioner who having clean antecedent is in custody since 21.08.2017.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.57201 of 2017 (2) dt.14-12-2017 2/2 the prayer of bail is allowed and the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gaya, in connection with Mahkar Police Station Case No. 67 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
