The petitioners apprehend their arrest in connection with Excise Case No. 77 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Submission of learned counsel for the petitioners is that petitioners are innocent and have falsely been implicated in the present case due to illegal motive of Police. Further submission is that entire allegations levelled against the petitioners are false and concocted. Petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.54297 of 2021(2) dt.08-04-2022 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners by contending that the alleged recovery of illicit liquor has been made from the conscious possession of the petitioners. Hence, this is not a fit case of anticipatory bail.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioners.
