2. The petitioner seeks bail in connection with Parasi P.S. Case No. 120 of 2024 instituted for the offences punishable under Sections 191(2), 190, 115(2), 117(2), 109, 303(2), 352, 351(2) and 351(3) of the B.N.S., 2023.

3. The allegation against the petitioner and other coaccused persons is to have assaulted the informant and his family members by means of lathi and iron rod due to which, they sustained injuries.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to dirty village politics. He submits that petitioner and informant are residing in same village. He further submits that there is case

Patna High Court CR. MISC. No.44676 of 2025(2) dt.16-07-2025 2/3 and counter case. He next submits that the injury of one Brajesh Kumar, Son of the informant is caused to be simple in nature. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 21.01.2025.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

From perusal of the FIR, injury report and case diary which has been produced by learned counsel for the petitioner under Section 230 of the B.N.S.S, is received in learned Magistrate Court as also perused the impugned order of the learned District and Additional Sessions Judge-1st, Arwal dated 11.03.2025, it appears that the only injury found on the body of son of the informant is of lacerated wound of size 3 cm x 0.5 cm x 0.25 cm over right parietal region of head and nature of injury is simple caused by hard and blunt substance, no specific allegation against the present petitioner and he is in custody since 21.01.2025, there is case and counter case attributed between the parties, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on
