Heard the counsels for the parties.
The petitioner seeks bail in connection with Maner P.S. Case No. 113/2017 dated 18.03.2017 instituted for the offences under Sections 328, 376 and 511 of the Indian Penal Code read with Sections 8 and 12 of the POCSO Act.
The petitioner and one Lalu Kumar are alleged to have taken away the 14 years old girl of the informant and had made attempts to outrage her modesty. The victim girl has supported the
Patna High Court Cr.Misc. No.57608 of 2017 (3) dt.11-01-2018 2/2 aforesaid allegation in her statement recorded under Section 164 of the Cr.P.C.
Learned counsel for the petitioner has submitted that the petitioner is the next door neighbour of the informant and because of a dispute over the drainage near the house of the informant and the petitioner, the petitioner has falsely been implicated in this case. It has also been submitted that the petitioner is also of tender age.
However, considering the nature of accusation against the petitioner, this Court is not inclined to grant bail to him for the present.
The prayer for bail of the petitioner is thus rejected. (Ashutosh Kumar, J.) Rakhi U T
