JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 This application has been filed for cancellation of bail granted to the O.P.no.2 and 3 by the learned Sessions Judge, Vaishali at Hajipur in A.B.P. no.2338 of 2017 in connection with Bidupur P.S.case No.375 of 2017 for the offence registered under Sections 363, 365, 368 and 384/34 of the Indian Penal Code.

Grounds for cancellation of the bail are that there are specific allegation against the O.P.no.2 and 3 of kidnapping of the daughter of the informant (petitioner) and till now she is traceless and the investigation of the case is going on but without considering the same the learned Sessions Judge has granted bail to the O.P.nos. 2 and 3.

Patna High Court CR. MISC. No.13742 of 2018(8) dt.18-02-2020 2/2 Heard learned APP and perused the impugned order passed by the learned Sessions Judge, which is a detailed order and considering the submission of the learned counsel for the O.P.no.2 that the daughter of the informant (petitioner) has married with the O.P.no.2 (Nitin Kumar) and she was residing with him and in support of his contention, Pan Card was filed and a copy of the Adhar Card which was applied on 23.1.2017 was also filed showing the daughter of the informant as the wife of Nitin Kumar as well as considering the other materials available on the record, the learned Sessions Judge has granted anticipatory bail to the O.P.nos. 2 and 3 and there is no allegation of misuse of the privilege of bail or tampering with the evidence.

As there is nothing in the order impugned, accordingly, this application is dismissed.
