====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 30-01-2021 The present modification application has been filed for modification of the order dated 05.11.2020 passed in Cr. Misc. No. 5811 of 2019.

It is submitted that since process under Section 82/83 Cr.P.C. has already been initiated, vide order dated 05.11.2020, on the prayer of the learned counsel for the appellant, instant application was permitted to be withdrawn, but in the order, inadvertently it was typed that the learned counsel for the appellant seeks permission as the appellant has surrendered before the learned court below though the appellant has not surrendered as yet.

Accordingly, order dated 05.11.2020 is modified to the extent that the appellant seeks permission to withdraw this

Accordingly, the modification application is disposed of.
