JUSTICE MADHURESH PRASAD ORAL ORDER 16-03-2018 The present application has been filed for restoration of Miscellaneous Appeal No. 231 of 2014 dismissed on 05.02.2015 for non-compliance of the order dated 22.01.2015 whereby this Court had allowed two weeks time to the counsel for the appellant for removing the defects pointed out by the office. Counsel for the appellant submits that he had informed the appellant to come and swear the affidavit for removing the defects pursuant to the order dated 22.01.2015 but the appellant did not come in time so the defects could not be removed. The said assertion only shows laches on the part of the appellant.
Patna High Court MJC No.1070 of 2016 (4) dt.16-03-2018 2/2 No case is made out for restoration. The application is accordingly, dismissed.
