The present writ petition has been filed for the following reliefs:- "(i) For issuance of direction to the respondent authorities to grant voluntary Retirement to the petitioner as he has already submitted his application on 21.04.2026 before the Superintendent of Police, Kaimur (Bhabhua) as he is not medically fit for doing the police services.

(ii) Also for issuance of direction to the respondent authorities particularly

Patna High Court CWJC No.10594 of 2026(2) dt.21-07-2026 2/3 the Superintendent of Police, Kaimur (Bhabhua) that after accepting the granting Voluntary Retirement to the petitioner pay all the dues amount to the petitioner for which he is entitled."

Today when the matter was called out at 10:30 A.M., the learned counsel for the State was directed to seek telephonic instructions that within what time, the decision with regard to grant of voluntary retirement of the petitioner will be taken by the respondent authorities and the matter was directed to be taken up at 02:15 P.M.

When the matter has been taken up at 02:15 P.M., the learned counsel for the State provides to this Court a copy of Memo No. 3016 dated 10.07.2026, issued under the signature of the DIG, Shahabad Range, Dehri-on-Sone, whereby the voluntary retirement application of the petitioner has been considered and in terms of Rule 74(ख) of the Bihar Service Code, the petitioner has been given voluntary retirement w.e.f. 28.02.2026. The Superintendent of Police, Kaimur has been directed to adjust the period from 12.01.2026 to 28.02.2026 from the leave of the petitioner in accordance with law and to proceed further.

5. Since the application for voluntary retirement of the

Patna High Court CWJC No.10594 of 2026(2) dt.21-07-2026 3/3 petitioner has been accepted vide Memo No. 3016 dated 10.07.2026, the grievance of the petitioner in the present writ petition has been redressed. Accordingly, the present petition has become infructuous.

6. It is expected that since the authorities have granted voluntary retirement of the petitioner w.e.f. 28.02.2026, all his service related benefits, including the post retiral benefits will be paid to him by the authorities without any further delay.

7. A copy of Memo No. 3016 dated 10.07.2026 has been kept on record for future reference.
