KUMAR ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks regular bail in connection with Kishanganj P. S. Case No. 341 of 2017, registered under Sections 328, 363, 365 and 34 of the Indian Penal Code,. The prosecution case as lodged on the basis of the informant, Sabnam Praween, victim girl, aged about 15 years is that when she had gone to market to purchase fish but suddenly she became thirsty and wanted to drink water but in the meantime,one boy and one girl offered her cold drink and upon taking drink, she felt dizziness then both the girl and boy took her on motorcycle to another house where also she felt thirsty and was again given cold drink and she again started feeling

No.894 of 2018 (4) dt.01-02-2018 2/2 dizziness and she was again carried on the motorcycle but in the way, motorcycle met an accident and all the three persons sustained injuries in the said accident and thereafter all the three were taken to Sadar hospital, Kishanganj where F.I.R. has been registered by the informant, Sabnam Praween.

It has been stated on behalf of the petitioner that the petitioner is innocent and no case of kidnapping is made out against him. It has been further submitted that the petitioner has no criminal antecedent and he is in custody since 04.07.2017. Having considered the said facts and circumstances, let the petitioner, Aslam Sekh @ Aslam Sheikh, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kioshanganj in connection with Kishanganj P.
