JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-03-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Maner P.S. Case No. 247 of 2019 registered for offence punishable under section 366 (A) of the Indian Penal Code. As per FIR, the daughter of the informant aged 16 years went out for nature's call, but she did not return. The informant received a telephonic call from her daughter that the present petitioner enticed her away for the purposes of marriage. The learned counsel for the petitioner has submitted that the statement of the victim was recorded after four days of her

Patna High Court CR. MISC. No.40777 of 2020(5) dt.08-03-2022 2/2 recovery, in which she has stated that the present petitioner kept her 11⁄2 years in Delhi. He has submitted further that the victim filed an affidavit dated 28.12.2020, in which she has stated that she has solemnized her marriage with one Bittu Yadav and in that affidavit itself her age has mentioned as 20 years. Considering the above mentioned facts and circumstances as well as the fact the victim is of 20 years age and she has not levelled any allegation of ill treatment against the present petitioner in her statement recorded under section 164 Cr.PC, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur in connection with Maner P.S. Case No. 247 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
