JUSTICE SANJAY KUMAR ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and perused the record.
The petitioner seeks bail in connection with Pirbahore Police Station Case No. 411 of 2017 registered for offences punishable under sections 461, 411 and 379 of the Indian Penal Code.
It appears that the above case was registered against the unknown persons. In course of investigation, one co-accused Karan Kumar @ Raj Kumar was arrested and he confessed his complicity in the above crime. He disclosed the name of this petitioner and co-accused Ashok Ram. From possession of said Ashok Ram, three stolen mobiles were allegedly recovered and he has already been allowed bail by a coordinate Bench of this Court in Criminal Miscellaneous No. 54396 of 2017 on 16.11.2017. The
Patna High Court Cr.Misc. No.57092 of 2017 (2) dt.12-12-2017 2/2 petitioner is in custody since 5.10.2017 and his name also transpired on the confessional statement of co-accused Ashok Ram.
Considering the fact that the case of this petitioner stands on similar footing to the case of co-accused who has been allowed bail in the above case, the prayer for bail is allowed and the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Patna in connection with Pirbahore Police Station Case No. 411 of 2017.
