The petitioner seeks bail in a case instituted for the offences under Sections 399, 402, 413, 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. Prosecution allegation, in short, is that accused persons while seeing the police started fleeing away but some of them were apprehended and on their possession one motorcycle and one loaded country made pistol were recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.2.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the
Patna High Court CR. MISC. No.41656 of 2019(2) dt.08-07-2019 2/2 petitioner. The motorcycle in question belongs to the petitioner. There is no recovery of any fire arms from the possession of the petitioner. The arms is alleged to have been recovered from coaccused Parvez Alam. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 107/19.
