The petitioner seeks bail in Chanpatiya (Sirisiya OP) P.S. Case No. 209 of 2020, registered for the offence punishable under Section 302 and other allied sections of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 29.01.2021 passed in Cr. Misc. No. 35558 of 2020. Petitioner has renewed his prayer for bail on the ground that though petitioner is alleged to have assaulted the deceased on head and neck, but no injury has been found on the neck of deceased and 03 persons are alleged to have assaulted the deceased on his head, but only 02 injuries have been found on

From perusal of order dated 29.01.2021, it appears that after considering all the materials available on record, prayer for bail of the petitioner has been rejected. Considering the fact that no fresh ground has been made out for reconsideration of the prayer for bail, therefore, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
