JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 10-07-2025 In the instant petition, petitioner seeks following relief(s):- For issuance of an appropriate writ/ writs in the nature of MANDAMUS for commanding and directing the respondents authorities for settlement of his compensation amount against land acquired under land acquisition process taking into consideration the earlier settlement with payments, which were withdrawn on basis of complaint filed belatedly and
Patna High Court CWJC No.10610 of 2025 dt.10-07-2025 2/3 further prayer for payment of admitted dues with interest at market rate in addition to litigating cost for unnecessary harassment and for other necessary relief/relief's on the basis of facts and circumstances of the case as stated, enumerated and discussed hereinafter.

Learned counsel for the petitioner submits that the land of the petitioner was acquired for the purpose of construction of National Highway 227A and after acquisition compensation amount i.e. Rs. 14,50,553/- (Annexure P/1), was also released in favour of the petitioner. Petitioner is aggrieved by Memo No. 350 dated 03.04.2024 issued from the office of the Land Acquisition Officer, Siwan, whereby on the objection of one Shyam Deo Singh dated 04.03.2024, the date of hearing was fixed on 20.04.2024 (Annexure P/2) and petitioner was directed to appear along with relevant documents. Learned counsel submits that petitioner appeared on the date of hearing and supplied all relevant documents as directed by the Land Acquisition Officer, Siwan but the objection petition has not been decided as yet and the same is still pending for consideration. He further submits that petitioner has already submitted affidavit, rent receipt and family pedigree issued by
Patna High Court CWJC No.10610 of 2025 dt.10-07-2025 3/3 the Circle Officer, Maharajganj (Annexure P/1) before the Land Acquisition Officer, Siwan which indicates that Shyam Deo Singh is not in any way connected with the petitioner. So, the objection petition should be decided expeditiously.
3. Learned counsel for the State submits that the said objection petition should be decided expeditiously, if the same has not been decided as yet.
4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the present writ petition stands disposed of with direction that the concerned authority shall hear the parties concerned and decide the grievance of the petitioner expeditiously preferably within eight weeks from the date of receipt of the order without being prejudiced by the order passed by this Court.
