The present writ petition has been filed with the following reliefs:- "(i) For quashing/ setting aside the memo no. 3/ Aa. 1-84/2025-250 Patna dated 23.05.2025 issued by the Special Secretary cum Director, Administration, Education Department, by which the petitioner has been suspended allegedly

Patna High Court CWJC No.10240 of 2025(2) dt.07-07-2025 2/3 under the relevant provisions of the Bihar Government Servant (Classification Control and Appeal) Rules, 2005 for allegedly prima facie proved charges of certain allegations on the basis of alleged report of the Deputy Development Commissioner, East Champaran contained in Letter no. 683 dated 09.04.2025 submitted to the District Magistrate, East Champaran;

(ii) For quashing/ setting aside the report contained in the Letter no. 683 dated 09.04.2025, submitted by the Director, Accounts, Administration and Selfemployment, District Rural Development Authority, East Champaran to the Deputy Development Commissioner, East Champaran;

(iii) Any other order/orders/direction, which your Lordships may deem fit and proper."

3. Learned Counsel for the petitioner submits that the present writ petition has been filed challenging his suspension along with other reliefs. He submits that after filing the writ petition suspension has been revoked.

4. In this view of the matter, Counsel for the petitioner seeks permission to withdraw this application.

5. Permission is accorded.

6. This writ application is dismissed as withdrawn.

7. It transpires to this Court that the second relief has been made for challenging the in house enquiry. This Court deem it fit that this is not the appropriate stage to challenge the in house enquiry. However, liberty is hereby granted to the respondents that if they want to proceed on the said inquiry report they can proceed.
