2. The petitioner seeks regular bail in connection with Sheikhpura P.S. Case No. 36 of 2023, lodged on 24.01.2023 under Section 392 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against 4 unknown accused persons against whom there is an allegation that they have looted Rs.12,50,000/- (Rupees Twelve Lacs Fifty Thousand) from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the criminal antecedent of the petitioner is not clean and there are six criminal cases pending against him. The petitioner is in custody since 13.05.2024 in the present case. Counsel further submits that the name of the petitioner has been

No.50168 of 2024(2) dt.24-07-2024 2/2 figured in this case by virtue of the confessional statement of the co-accused person namely Raushan Kumar @ Kaju who has been granted bail by the Co-ordinate Bench of this Court vide order dated 07.08.2023 passed in Cr. Misc. No.19167 of 2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the criminal antecedent of the petitioner is not clean as there are six criminal cases pending against him and this aspect must be taken into consideration.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Sheikhpura P.S. Case No. 36 of 2023, pending before the learned Chief Judicial Magistrate, Shiekhpura is hereby rejected.

8. Liberty is hereby granted to the petitioner that he may renew his prayer for bail six months after framing of charge.
