The petitioner seeks bail in connection with Nanpur P.S. Case No. 11 of 2020 instituted for the offences under Sections 25(1-b)A, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 12.04.2021, charge-sheet has been submitted in the case and has antecedent of one case as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that allegation is of recovery of a country-made pistol along with a live cartridge and mobile from co-accused who disclosed the name of the petitioner alleging that he fled from the place of

Learned counsel for the petitioner submits that the name of this petitioner transpired in the confessional statement of co-accused and he was not arrested from the spot as such nothing was recovered from his possession.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 12.04.2021, charge-sheet has been submitted in the case and his name transpired in the confessional statement of coaccused, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Nanpur P.S. Case No. 11 of 2020. (Satyavrat Verma, J) Rishi/- U T
