Petitioner apprehends arrest in a case registered for the offence punishable under Section 429 of the IPC and section 5/91 of Wild Life Protection Act and section 30/27 of the Arms Act.

As per the prosecution case, it is alleged that this petitioner along with other co accused persons fired shot on Nilgai through his licensee rifle.

It is submitted that the petitioner has been made accused in this case only on suspicion and there is no eye witness of the occurrence. Petitioner has got no criminal

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learnedACJMIII, Siwan in connection with Barharia P.S.Case No. 51 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
