JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Rupauli P.S. Case No. 43 of 2019 for the offenses under Section 7 of the Essential Commodities Act. It is alleged that the petitioner was involved in the black marketing of Gas Cylinder.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. the incident is dated 30.4.2019 whereas the FIR was lodged on the basis of the written report of Block Supply Officer on 3.5.2019. The petitioner is the driver and has no concern with the black marketing of Gas Cylinder. The petitioner is in custody since 3.5.2019.
