====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 01-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 452, 386, 379, 506/34 of the Indian Penal Code and Section 3/4 of the Explosive Substance Act.

This is a case of misuse of privilege of bail. Submission is that the petitioner had no knowledge about the case ever and he never got bail from the Court in this case. Petitioner has got no criminal antecedent. All of a sudden, petitioner was arrested in this case on 25.02.2019 and since then he is in custody.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

No.47237 of 2019(2) dt.01-08-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 329 of 2019 arising out of Digha Police Station Case No. 19 of 2009, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
