JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-01-2023 Heard learned counsel for the petitioner and learned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 406 & 34 of the Indian Penal Code.

Allegations against the petitioner are of cheating and misappropriation of amount of Rs. 20 lakh which was given to him by the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner and has no concerned with the alleged offence and has falsely been implicated in this present case. He has got no criminal antecedent. It is further submitted that it is a case of

No.44178 of 2022(3) dt.09-01-2023 2/2 business transaction and there is no documentary proof available in respect of giving cash of 20 lakhs to the petitioner by the informant rather the informant deposited a sum of Rs. 46 lakhs in the bank account petitioner's father and brother. It is further submitted that the petitioner is languishing in judicial custody since 19.4.2022.

Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Aurangabad Town P.S. Case No. 434 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad.
