Petitioner seeks regular bail in connection with Sursand PS Case No. 200 of 2021 registered for the offence punishable under Sections 363 and 366 (A) / 34 of the IPC and Section 8 of the POCSO Act.

Minor daughter of the informant has allegedly been abducted by the accused persons for the purpose of marriage.

Learned counsel for the petitioner submits that petitioner is the father of the co-accused / Sudhir Raut with whom the victim lady was having love affair. He next

Patna High Court CR. MISC. No.53428 of 2021(2) dt.12-05-2022 2/3 submits that statement of the victim girl under Section 164 Cr.P.C. was recorded by the learned Magistrate in which she has stated that she was in love with the co-accused / Sudhir Raut and has performed marriage in temple on her free will. He next submits that nothing has been said against the petitioner by the victim girl in her statement recorded under Section 164 CrPC. The co-accused / Sudhir Raut and Rekha Devi have been granted anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. Nos. 59091 / 2021 & 58942 of 2021 respectively. The petitioner is in custody since 25.6.2021.

Regard being had to the submissions made by the parties, taking into consideration the material on record, the statement of the victim girl recorded under Section 164 of the Cr.P.C. and the fact that co-accused persons have been granted anticipatory bail by this Court , as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000 /- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VI,
