JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 The petitioner is apprehending his arrest in connection with Simri P.S. Case No. 99 of 2017, registered for offences punishable under Sections 341, 342, 323, 354, 448, 449, 436, 427, 307, 379, 504, 506/34 of the Indian Penal Code and Section 302 of the IPC has been added.

Allegation against the petitioner and others that they entered into the house of informant and ransack the house of the informant and also set her mother Tetri Devi on fire, due to which she sustained burn injuries and succumbed to her injuries. It has been submitted on behalf of the petitioner that he is not named in the F.I.R, his name has been dragged in this case during course of investigation and he has been made accused only on the basis of suspicion and has no role to place in the

Learned counsel for the State opposed the prayer for bail and submitted that the deceased Tetri Devi in her statement has specifically named the petitioner along with others. Having heard both sides, considering the facts and circumstances of the case and nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner, rather he should surrender before the court below and pray for regular bail, which will be considered on the merit of the case.
