This application has been filed for quashing the order dated 17.09.2014 passed in S.Tr. No. 339 of 2012 by learned Additional Sessions Judge-1st, Sitamarhi by which the petition filed under Section 227 Cr.P.C. for discharge was rejected. A report has been called for from the court below about the present stage of the case which has been received. The court below has mentioned in the report which is kept at flag 'R', that charge has already been framed in this case. Three witnesses out of eight witnesses have been examined. Patna High Court Cr.Misc. No.3738 of 2015 (6) dt.19-03-2018 2/2 progress as appear from the report of the court below. In such circumstances, this Court does not deem it proper to interfere with the impugned order. This application is accordingly disposed off, with direction to the court below to proceed with the trial in accordance with law and make efforts to dispose of the same as early as possible.
