2. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
3. As per F.I.R., on 01.10.2017 at 02:00 P.M., the informant came to know that his cousin namely Kedar Bin was killed by these two petitioners who were owners of the Rajshree Hotel where he (deceased) was working from the last one month owing to money dispute, and the dead body of the deceased was thrown.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.51315 of 2025(3) dt.03-11-2025 2/2 informant is not the eye witness of the occurrence and only suspicion has been raised against these petitioners. After investigation police submitted final form against these petitioners differing with the same, court below has taken cognizance.
5. Learned counsel for the State oppose the bail petition.
6. Considering the nature of accusation and the fact that police submitted final form against these petitioners, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Bhojpur at Ara in connection with Piro (Hasan Bazar) P.S. Case No. 259 of 2017, subject to the conditions laid down under section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) AjayMishra/- U T
