Order dated 23.01.2020 passed by the Collector, Supaul in Confiscation Case No 17 of 2016 in exercise of power under Section 6A of Essential Commodities Act (for brevity, the Act) is under challenge in the present application whereby, the food grains and other articles said to be belonging to the petitioner, have been confiscated.

Patna High Court CWJC No.2437 of 2021(2) dt.18-01-2022 2/2 The petitioner, apparently, did not invoke the remedy of appeal under Section 6C of the Act and has filed this writ application nearly 11 months after passing of the impugned order.

Learned counsel for the petitioner, after some argument, seeks permission to withdraw this application with liberty to prefer appeal against the said order. Permission is accorded.

This application is dismissed as withdrawn with the liberty, as sought for.
