Heard the learned counsel for the petitioner and learned counsel appearing for the State.

During the pendency of this writ application petitioner has been paid all the benefits. Now the petitioner confines his grievance of non-payment of revised family pension since 01.01.2003.

The writ petition was filed with a prayer to issue direction to authority concerned to make payment of arrear of revised family pension in terms of revised pay scale w.e.f. 01.01.1996.

Patna High Court CWJC No.1143 of 2016 (5) dt.13-10-2017 2/2 Undisputedly the grievance raised by the petitioner has been redressed by the respondent.

In view of the statements made in the rejoinder to the counter affidavit it appears that the grievance with respect to the subsequent revised pension has not yet been redressed. As such, this application stands disposed of with liberty to the petitioner to file detail representation along with a copy of this order before the respondent no.3 and the District Programme Officer (Establishment), Gaya, respondent no.3 is directed to see that all the admissible dues with respect to the revised pension is paid to the petitioner within a period of three months from the date of such representation. If the admitted claims are not paid within the time stipulated herein above, respondent shall be liable to pay interest at the rate of 9% per annum from the date of accrual of the claim till the date of actual payment.

With the aforesaid observation this application is disposed of.
