JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-08-2019 By an order, dated 09.01.2007, passed in C.W.J.C. No. 13415 of 2006, the petitioners of the said writ application were required to remove defects by depositing deficit Court fee within peremptory time. For non-compliance of the said

Patna High Court MJC No.893 of 2014(5) dt.02-08-2019 2/2 peremptory order, the writ application stood dismissed in 2007. For restoration of the said C.W.J.C. No. 13415 of 2006, the present application has been filed nearly seven years after dismissal of the writ application. The explanation, that the petitioners could not be communicated about the requirement of depositing the Court fee within time, is not at all convincing. This application is accordingly dismissed.

It is, however, indicated that dismissal of the present restoration application will not come in way of the petitioners pursuing their claim before the respondents of C.W.J.C. No. 13415 of 2006.
