JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Complaint Case No. 1036C of 2019 for the offences punishable under Sections 494, 495, 420 of the Indian Penal Code.
It is a case of cruelty and torture for non fulfillment of dowry of Rs. 23,00000/-.( Twenty three lacs.) Learned counsel for the petitioner submitted that petitioner has falsely been implicated in the present case. Petitioner and complainant has jointly filed Matrimonial Case no. 1276 of 2017 under section 13B of the Hindu Marriage Act. After taking statement of both the parties, learned Principal
Patna High Court CR. MISC. No.39867 of 2020(3) dt.08-03-2022 2/2 Judge has passed judgment& decree dated 29.08.2018. It is further submitted that complainant has never challenged the aforesaid order and the petitioner had paid settled amount of Rs. 15,000/- per month as alimony for this divorce. Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- XIV, Patna in connection with Complaint Case no. 1036C of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
