JUSTICE ARUN KUMAR JHA ORAL ORDER 21-12-2023 The learned counsel for the petitioner submits that defect nos. 73 and 84, as pointed out by the office, have been removed and he seeks permission to remove the defect no. 21 in course of the day.

2. He is permitted to do so in course of the day.

3. The learned counsel for the petitioner submits that earlier he has come before this Court by filing Civil Misc. No.140 of 2017 in which the judgment was passed on 23.08.2022, but the judgment contains some erroneous facts and the petitioner intends to pursue legal remedies for modification of the aforesaid judgment dated 23.08.2022 and wants to withdraw the instant petition with the aforesaid liberty.

4. In view of the prayer of the learned counsel for the petitioner, the instant petition is dismissed as withdrawn but with observation that there is no need to grant any such liberty
