1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 318(4), 64, 352, 351(2) of the B.N.S.S.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her husband was doing a private job, further alleges that petitioner, who is a distantly related brother of her husband used to come to her house for the last two years, accordingly, the petitioner and the informant became intimate and used to talks on mobile, next alleges that petitioner took nude pictures of the informant without her knowledge and thereafter started threatening that the same would be made viral, based on the

No.44250 of 2025(2) dt.16-07-2025 2/3 threat he established physical relationship, further alleges that petitioner also threatened that in the event if she will not maintain relationship with him, in that event, he will kill her child and will make the video viral. It is next alleged that when informant complaint about the same to her husband on 13.04.2025, when the petitioner again came and assaulted her and even abused and assaulted her and her husband.

The learned counsel appearing on behalf of the petitioner submits that from perusal of the allegation, as alleged in the FIR, it would manifest that the petitioner used to visit the house of the informant and accordingly they became close and thereafter they entered into a relationship and even established physical relation. It is next submitted that the allegation of taking nude pictures is wild imagination of the informant as the pictures were never made viral nor petitioner has any such pictures. It is also submitted that since husband of the informant came to know about their relationship, as such the instant false case came to be instituted. It is submitted that the relationship was consensual and when the husband of the informant came to about the same, the relationship soured and the instant FIR came to be instituted. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove his

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sahayak Khazanchi P.S. Case No.147/2025, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this court is not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
