2. Writ petition has been filed for directing respondent authorities for consideration of petitioner's legal right declared in terms of order dated 11.7.2018, passed by the DCLR, Aurangabad in Preemption Case No. 06 of 2008 which attained finality after dismissal of Appeal No.23/2019 on 13.9.2019 filed by private respondent no.5.

3. At the outset, learned counsel for the State submits that the present writ petition has become infructuous in light of judgment of the Hon'ble Division of this Court dated 13.10.2023, passed in C.W.J.C.No. 15060 of 2019 and other analogous writ petitions.

4. Writ petition is dismissed as being infructous in view of the aforesaid judgment of this Court. (Prabhat Kumar Singh, J) Shashi U
