====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 09-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Fulwari (Janipur) P.S. Case No. 819 of 2025 dated 26.05.2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per the prosecution case, total 160 litres of country made liquor was recovered from the E-rickshaw of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.42868 of 2025(2) dt.09-07-2025 2/3 this case. It is submitted that the petitioner is not the owner of the said E-Rickshaw rather is the driver of the said vehicle. It is further submitted that on the direction of the vehicle owner, when the petitioner was going to handover the said vehicle to the owner's friend for a day for his personal use, he was arrested by the police. The petitioner had no knowledge that the illicit liquor was kept on the said vehicle. The petitioner is the sole bread earner of his family who works only in the capacity of a driver No incriminating article has been recovered from his possession. The petitioner has no any connection with the illicit liquor. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 27.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-1, Patna in connection with Fulwari (Janipur) P.S. Case No. 819 of 2025.
