1. Heard learned counsel for the petitioner and learned APP for the State. No one appears on behalf of opposite party no.2 despite valid service of notice.
2. A prayer for bail has been made on behalf of the petitioner in connection with Gidha P.S. Case no.106 of 2025 registered under sections 137(2) and 96 of the B.N.S, 2023.
3. The allegation in the F.I.R. is that the minor daughter of the informant was taken by a burkha-clad girl to a cyber cafe but did not return. Upon searching, the informant found his daughter in an unconscious condition along with that girl. The informant has raised suspicion that his daughter might

Learned counsel for the petitioner submits that it would be apparent from the F.I.R itself that the petitioner was made accused only on suspicion as she was present along with the informant's daughter while she was in unconscious state. It would further appear from the statement of the victim recorded under Section 183 of B.N.S.S that she was having a love affair with Lal Das who allegedly entered into physical relationship with her and the role of the petitioner is confined to having taken the victim to the hospital for treatment which she did in good faith. The statement of the victim girl also discloses that she had actually gone to the doctor along with Lal Das where her pregnancy got terminated. Learned counsel for the petitioner further submits that thrust of the allegations, even according to the statement of the victim, remains confined to co-accused Lal Das. The petitioner, being a lady, is in custody since 29.04.2025 and charge-sheet has been submitted in the case.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Taking into consideration the above mentioned facts of the case and also considering that thrust of the allegations is against co-accused Lal Das and the victim has also

No.44379 of 2025(6) dt.05-12-2025 3/3 accepted that the she was in love relationship with him coupled with the fact that role of the petitioner remains confined to taking her along to cyber cafe and then for treatment and further considering that she is in custody since 29.04.2025 and chargesheet having been submitted in the case, let the petitioner, above named, having no criminal antecedent, be directed to be enlarged on bail in connection with Gidha P.S. Case no.106 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/successor Court.
